
Terms and Conditions

These terms and conditions govern the relationship between the customer and Your Luxury Safaris company for the provision of safaris and travel-related services. By using our services, you consent to abide by these terms and conditions. The purpose of these terms and conditions is to set out the rights and obligations of both parties and to provide clarity on the terms of the agreement.
Booking and Payment

Registration process:
To book a safari with us, you must fill out our registration form and submit it to us. Based on the information provided, we will create a personalized travel plan tailored to your needs and preferences.
To secure your booking, a deposit of 30% of the total cost of the safari is required. The remaining balance must be paid in full no later than 12 weeks before the start of the safari. If the balance is not paid by the due date, we reserve the right to cancel your booking and retain your deposit.
Payment can be made by bank transfer, credit card, or Pesapal. All bank charges and fees incurred in receiving payments will be passed on to you and must be paid in addition to the cost of the safari.
Any quote offered to you is valid for 7 days from the date of issue, after which we may have to adjust the price due to cost changes.

Arrangements:
Once you have completed the registration process and paid your deposit, we will begin making arrangements for your safari. This includes booking your accommodations, arranging your transportation, and organizing your activities. We will keep you updated on the progress of your itinerary and any changes that may occur.

Taxes:
All taxes and fees associated with your safari are included in the price of your trip, except International airport taxes which are not included. You will not be charged any additional fees or taxes unless you make changes to your itinerary that result in additional charges.

Cancellations:
Your Luxury Safaris applies different cancellation fees depending on how much notice is given before the departure date:

90+ days before departure: 80% refund

60-89 days before departure: 50% refund

30-59 days before departure: 25% refund
-
15-29 days before departure: 10% refund

Less than 14 days before departure: No refund
! Please note that certain camps may impose higher cancellation fees during peak booking periods, such as Christmas. These fees could exceed the usual cancellation charges. If this affects your booking, we will notify you in writing at the quote stage and before you make your deposit payment. Once your deposit is paid and we have issued the Confirmation Invoice, you will be responsible for these higher cancellation fees.
In the case that you have already paid your international flights upfront at the deposit stage, please be aware that these costs are non-refundable and will be retained by us in addition to the cancellation fees mentioned above.
If your cancellation is covered by your insurance policy, you may be able to recover these fees. We can provide a cancellation invoice to support your insurance claim.

If you need to make changes to your booking
If you wish to modify your travel arrangements after we have issued the confirmation invoice, such as changing your departure date or accommodation, we will do our best to accommodate these changes, though they may not always be possible. Any change requests must be submitted in writing by the person who made the original booking. An administration fee of $110 per person will apply, in addition to any extra costs we incur in making the changes. Please note that the closer the change is made to your departure date, the higher the associated costs are likely to be, so it's advisable to contact us as soon as possible. Some travel arrangements may not be amendable after booking, and alterations could result in a cancellation fee of up to 100% for that portion of the arrangements. Specifically, changes made within 90 days of departure will incur the cancellation charges mentioned above.
You may transfer your booking to another person who meets all the requirements of the booking, provided we are notified in writing at least 7 days before departure. Both you and the new traveler will be responsible for covering any costs we incur in processing the transfer.

Deposit Policy
Deposits are non-refundable after 61 days before departure, ensuring commitment to the trip while covering essential reservation costs.
We strongly recommend purchasing travel insurance to cover any unforeseen cancellations. We reserve the right to cancel your holiday at any time should such a policy not be taken out by you.

Credit Option for Late Cancellations
For cancellations made within 30 days of departure, we offer the option of a credit note valid for 12 months, which can be used towards future bookings.

Guaranteed Departures:
YLS guarantees the departure of all group programs upon receipt of a deposit, except in cases of force majeure, which includes any event that negatively affects international travel patterns such as epidemics, acts of God or government, terrorism, and other circumstances beyond YLS’s control. In the event that the minimum number of travelers is not met, YLS may substitute local guides at each location and Extensions are guided locally. In the unlikely event that a departure is canceled, YLS will notify you as soon as possible and offer the choice of transferring to another departure or receiving a full refund.

Changes to the Itinerary
We reserve the right to modify the itinerary or substitute accommodations, activities, or transportation if circumstances beyond our control make it necessary. We will make every effort to provide a comparable alternative and will notify you of any changes as soon as possible.

Travel Documents
It is your responsibility to ensure that you have a valid passport, visa, and any other travel documents required for your safari. We accept no responsibility for any costs, losses or damages you may incur as a result of your failure to obtain the necessary travel documents.

Medical Conditions, Disabilities, and Special Requests
If you have any medical conditions or special needs, please inform us before booking to determine whether your plans are feasible. Certain destinations may not be suitable, and we reserve the right to decline a booking if we cannot accommodate your needs. If you fail to notify us in advance, we may have to cancel your booking once we become aware of the situation.
We will pass on dietary and other special requests to our suppliers, but we cannot guarantee fulfillment.

Unused Services:
No refunds will be provided for any unused services or activities during your safari. If you choose not to participate in a scheduled activity, you will not be refunded for that activity.

2. Services

Accommodations: Accommodations are provided as described in the itinerary or booking details. The company reserves the right to substitute accommodations of a similar or higher standard if necessary, but will communicate any changes to the customer in advance.

Meals: Meals are provided as described in the itinerary or booking details. Most of our guests prefer Western food so that is our specialty. But through our accommodation and meal partners we can provide nearly any type of food that you need. If you would like to sample the local cuisine we are happy to provide this experience as well. We are also experienced in working with clients with unique dietary needs such as diabetics, gluten-free, vegetarian, vegan, and others.

Air Transportation: The company is not responsible for any delays, cancellations, or other issues related to air transportation. Customers should ensure that they have appropriate travel insurance to cover any such issues.

Luggage: Customers are responsible for their own luggage and should ensure that it is clearly labeled with their name and contact details. The company is not responsible for any loss, damage, or theft of luggage or personal belongings.

Wi-Fi and Laundry: Wi-Fi and laundry facilities are available at many accommodations but are not guaranteed, therefore the company is not responsible for any issues related to Wi-Fi or laundry facilities.
3. Responsibility
Our company is responsible for making sure that the hotels, transportation, and tour guides that you may need on your trip are chosen with reasonable skill and care. However, we do not own or operate these suppliers and cannot control their actions. As a result, We are not liable for any direct, indirect, consequential, or incidental damage, injury, death, financial or other loss, accident, delay, inconvenience, or irregularity of any kind that may be caused by any act or omission beyond our control, including but not limited to acts of God, war, terrorism, strikes, government restrictions, or any other force majeure event. You are responsible for making sure you have the right travel documents, like passports and visas, and for following any rules about customs and immigration.
If we need to cancel or postpone your trip, we will do our best to offer you alternative arrangements. In the event that the company is unable to operate a tour or package due to unforeseen circumstances, customers may be entitled to a refund or alternative arrangements. The company will communicate any cancellations or postponements to customers as soon as possible.
4. Miscellaneous
These terms and conditions are governed by the laws of the place where the services are provided, and any disputes that arise because of them will be handled according to those laws. These terms and conditions are the only agreement between you and our company. They replace any other talks, discussions, or agreements that you and our company have had in the past or in the present. Only a written agreement with both parties' signatures may amend or modify these terms and conditions. If any provision of these terms and conditions is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.
5. Intellectual Property Rights
All intellectual property rights, like copyrights, trademarks, and patents, belong to us or our licensors. This includes everything on our website and in our marketing materials. Without our written permission, you may not copy, reproduce, distribute, or create new works from any of the content on our website or in our promotional materials. You are also not permitted to use any of our trademarks or service marks without our prior written consent.

Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Tanzania. Any disputes arising out of or in connection with these Terms and Conditions shall be resolved exclusively by the courts of Tanzania.
By making a booking with us, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them.
